STRENGTHENING AARHUS CONVENTION IMPLEMENTATION PROJECT

This request for expressions of interest follows the general procurement notice for Strengthening Aarhus Convention Implementation Project, that appeared in the United Nations Development Business on line (May 2010). The Government of Albania has received a grant from the World Bank’s International Development Fund (IDF) to finance the Strengthening of Aarhus Convention Implementation Project. The Ministry of Environment, Forest and Water Administration (MoEFWA) in Albania has overall responsibility for the project. Ministry of Environment, Forests and Water Administration (through Aarhus Information Centre (Public Information & IT sector in the MoEFWA) and Department of Environmental Impact Assessment) and Ministry of Finance are responsible for the implementation of the Project activities assisted from the Project Management

Team. The Aarhus Center was opened in 2006 in MoEFWA for providing information to government bodies, civil society and to the public in general regarding AaC commitments. The Center is under the direction of both, the Information Technology and Communications Section and the Department of the Environmental Impact Assessment. The government's AaC focal point in this Ministry is also responsible for promoting compliance with AaC commitments of the public sector. Two regional Aarhus Information Centers in Shkodra and Vlora, established with the help of OSCE try to complement, from the perspective of the civil society, the watchdog role of the main Center.

Their main responsibility is to inform public on the environmental issues and AaC, to monitor the implementation of the local environmental legislation and AaC, to coordinate and gather data regarding the practical implementation of AaC . The objective of this assignment is to prepare regulations and guidelines related to procedures on provision of environmental information, public involvement and consultations, and submission of claims before administrative and judicial courts. The local consultant will assist the international consultant to identify and assess the institutional capacity of government structures which have a role in implementation the AaC as Ministries, local authorities including local government (municipalities, communes) Regional Environmental Agencies and other institutions with competencies in environmental issues (Agencies of Water Basins, Directories of Forestry etc). Attention must be paid the latest restructuring of MoEFWA, establishment of the National Licensing Center and the role of civil society in its role as a watchdog. The consultant will prepare draft regulations/guidelines and procedures on provision of environmental information, public involvement and consultations, and exertion of rights in administrative and judicial court. The use of local knowledge will contribute in terms of long-term sustainability. As appropriate, the specialist will consult with counterparts in both the GoA and the AaC Convention Secretariat in Geneva. The guidelines will be prepared based on the AaC provisions and its implementation guide, national strategy and existing national legislation and the finalized needs assessment report. In order to ensure that the guidelines will be applicable to all governmental agencies the consultant has to identify:

  • Institutions whose activities relate to environmental management and protection (other than MoEFWA);
  • Institutions which are responsible to inform and consult the public for environment related matters;
  • Institutions with functions and responsibility to address the public concern and complains regarding the environmental issues;
  • The existing national legislation (laws, by acts and guidelines) related to the scope of this assignment Qualifications:

The individual consultant shall have the following qualifications: University degree in law. At least 5 years of proven professional experience in environmental field especially in environmental legislation preparation and litigation; Knowledge of civil law; Knowledge of Aarhus Convention and implementation in Albania; Knowledge of Albanian governmental institution and environmental legislation; Fluency in both, written and spoken English; Good communication skills; Computer skills. Duration of the services:

The assignment is expected to involve 37 man/days. Total elapsed time for completion of the assignment should be not more than 120 days. Timeframe for product delivery will be agreed on the Contract. The consulting assignment is expected to start in September.

Selection

The service will be selected under the provisions of the World Bank Guidelines for the selection and employment of the consultants (May 2004, modified in October 2006 and May 2010), based on the method of Selection of Individual Consultants (IC), Time- Based Contract.
